POLICY AGAINST HARASSMENT IN THE WORKPLACE

The Food Runners is committed to providing a professional workplace free of all forms of unlawful harassment, discrimination and retaliation, including, harassment and discrimination based on a protected category. The purpose of this policy is to assure that no form of unlawful harassment, discrimination or retaliation occurs. The Food Runners has a strict policy against all harassment and will take appropriate correction actions in response to violations of this policy. We take great care to ensure compliance with the policy, and make clear that no form of harassment will be tolerated.

HARASSMENT

The Food Runners prohibits harassment, discrimination, and retaliation based on a protected categories including a person's race, color, religion, religious creed, national origin, ancestry, citizenship, primary language, marital status, sex, pregnancy, childbirth, breastfeeding, or related medical conditions, gender, gender identity, gender expression, sexual orientation, age, military or veteran status, physical or mental disability, medical condition, genetic characteristic or information, protected medical leaves, domestic violence victim status, political affiliation, and any other status protected by federal, state, or local laws.

While it is not possible to list all the circumstances that may constitute other forms of workplace harassment, the following are some examples of conduct that may constitute workplace harassment: a) the use of disparaging or abusive words or phrases, slurs, stereotyping, threats, intimidating or hostile acts; b) written or graphic material that insults, stereotypes or shows hostility towards an individual or group based of one of the above protected categories, posted or circulated in the workplace; and c) a display of symbols, slogans, or items that are associated with hate or intolerance towards any group.

SEXUAL HARASSMENT

According to the EEOC, sexual harassment in employment is unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. Sexual harassment applies to both sexes. These acts constitute sexual harassment when any of the following occur: a) either explicitly or implicitly, submission to such conduct is made a term or condition of an individual’s employment, b) submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting the individual and c) the conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.

While it is not possible to identify each and every act that constitutes or may constitute sexual harassment, the following are some examples of sexual harassment are provided below: unwelcome requests for sexual favors; lewd or derogatory comments or jokes; comments regarding sexual behavior or the body of another employee; sexual innuendo and other vocal activity such as catcalls or whistles; obscene letters, notes, emails, invitations, photographs, cartoons, articles, or other written or pictorial materials of a sexual natures; repeated requests for dates after being informed that interest is unwelcome; retaliating against an employee for refusing a sexual advance or reporting an incident of possible sexual; offering or providing favors or employment benefits such as promotions, favorable evaluations, favorable assigned duties or shifts, etc., in exchange for sexual favors; and any unwanted physical touching or assaults, or blocking or impeding movements.

REPORTING AND RETALIATION

Any employee who feels that he or she has witnessed, or been subject to, any form of discrimination or harassment is required to immediately notify their direct supervisor or other manager at The Food Runners.

In addition, The Food Runners prohibits retaliation against a person who engages in activities protected under this policy. Reporting, or assisting in reporting, suspected violations of this policy and cooperating in investigations or proceedings arising out of a violation of this policy are protected activities under this policy.

INVESTIGATION AND ENFORCEMENT

The Food Runners will promptly and thoroughly investigate any claim of harassment and take appropriate action whenever it deems such corrective actions necessary. If The Food Runners determines that harassment or discrimination occurred, corrective action will be taken to effectively end the harassment immediately. Discipline for violation of this policy may include, but is not limited to reprimand, suspension, demotion, and discharge. In all cases, The Food Runners will make efforts to ensure no retaliation for making a complaint or cooperating with an investigation under this policy.

Any delivery partner, customer, or any other third party who experiences sexual or other harassment may submit a complaint to our mailing address: PO Box 15532, Newport Beach, CA 92659. The Food Runners will keep all such complaints of harassment confidential to the extent possible. After receiving a complaint of sexual harassment, The Food Runners will perform an investigation into any complaints to reach reasonable conclusions and take the appropriate action based on the findings of the investigation. No person shall be retaliated against as a result of making a good faith complaint of sexual or other harassment, or for participating in a subsequent investigation. The Food Runners is committed to providing a safe environment and is committed to eliminating harassment to our employees, partners and the community.
